Yakima Police Officers were called to the 100 block of Union Street at about 7:11 am May 3 after a 911 caller told authorities his 39-year-old brother was having mental problems

He's currently listed in serious but stable condition.

No suspect has been identified and the motive for the shooting is unknown.

Authorities were called to the area by a neighbor who reported the shooting

22-year-old Daniel Ortega was killed at the park after police say he was "acting erratically and harassing a 28-year-old man and his son.

Now the case is in the hands of the Yakima County Prosecutor Joe Brusic who must decide if the Officers actions were justified.

When authorities arrived they found a man in the front yard of the home who had been shot multiple times.

When the Officers arrived they ordered Orduna-Mata to drop the gun but he instead threatened the officers

Yakima Police Capt. Jay Seely say a man was threatening to shoot family members who locked themselves in a home in the area as the man stood outside with a gun.

Officers were called to the area for shots fired. When they arrived they found a 53-year-old man sitting in the drivers seat of a van.
